Phame Factory slays Sony over ‘FLAY’ Slenderman controversy

The independent film ‘FRAY‘ (2017), based on the Slenderman mythos and directed by Eric Pham, was slated to be release in 2018. That was until studio giant Sony Pictures stepped in with a cease-and-desist order, claimimg the movie infringed on its own Slender Man (2018) character. A property to which Sony contentended it had exclusive rights. Needless to say, this set up a classic David and Goliath scenerario—0ne that would not be settled with a stone—but rather jurisprudence.

Phame Factory, the production company that produced ‘FRAY‘ perused legal action claiming that the

promotion and distribution of ‘FRAY‘ didn’t infringe on Sony’s copyrights.”

As of today, the underdog Phame Factory has won against Sony and is allowed to release its film, with conditions. The agreement between them stipulates that any ‘FRAY‘ promotional content have a disclaimer, as well as in the movie. Director Eric Pham told Deadline: “I’m now very happy to say that we obtained a very favorable resolution of this lawsuit and finally have the legal right to release our feature film.”

FRAY‘ will be released via digital platform on April 2, 2019.

For those that don’t know about Slender Man, the Creepypastas internet meme was created by Eric Knudsen in 2009. Since then Slender Man has grown from myth to film and real life murder games. In recent news, two twelve year old girls attempted to murder one of their friends to become proxies of Slender Man. The girls stabbed their friend 19 times in a wicked game of hide-and-go-seek. Christian A. Morán has been working on feature films, shorts, music videos and in documentaries, for which he won an award in 2002 at the Aurora Film Festival. As a Production Manager and Senior Editor at Media Blasters Inc., he has worked on and revived numerous Cult and Horror titles such as Lucio Fulci's Zombie 2, Takashi Miike's Ichi the Killer and One Missed Call. He also worked on post-production for Fever Dreams' feature, "Shadow: Dead Riot", starring Tony Todd of Candyman and worked on "Death Trance" directed by Yuji Shimomura and starring Versus' Tak Sakaguchi. Christian has also worked on animated titles including Invader Zim, Berserk, Giant Robo, Samurai Deeper Kyo, 12 Kingdoms and Voltron: Defender of the Universe. He also produced and edited a promotion video for a branch of The United Nations called Alliance of Civilizations which featured President Barack Obama. Currently, he is working with legendary producer Roger Corman and Code Red DVD, who handle titles from MGM (Metro-Goldwyn-Mayer). At this time he is producing and directing his own films such as Silentious (2013), Flawed God (2014), Halloween Treat (2014) and the award winning film, Let's Play Dead Girl (2015).
